Nestle’ Dairy Whitener Fails Quality Test: FSSAI Orders Immediate Halt To Sales

A sample of Nestle’s Low Fat Dairy Whitener has been found non-compliant with food safety and quality standards following laboratory testing, according to a notice issued by the Food Safety and Standards Authority of India (FSSAI). The sample was collected from The Lalit Hotel in Connaught Place, New Delhi, during an inspection of packaged food products. It was subsequently sent for analysis at the food analyst’s laboratory, where the product was found not to meet the standards prescribed under the Food Safety and Standards Act, 2006.
The food safety authorities have directed the concerned food business operator to stop the sale of the product immediately.
According to the FSSAI notice, the sample in question was identified as Nestle’s Low Fat Dairy Whitener. Officials collected it from the premises of The Lalit in Delhi’s Connaught Place and sent it for laboratory examination.
The food analyst’s report concluded that the sample did not conform to the requirements laid down under the Food Safety and Standards Act, 2006.
The finding relates to the particular sample tested by the authorities. FSSAI has communicated the laboratory results to the concerned food business operator and also supplied a copy of the analysis report for further action.

Notice Issued To Bharat Hotels

Following the test results, FSSAI has issued a notice to Bharat Hotels Ltd., which operates The Lalit, in connection with the non-compliant product sample.
The company has been allowed to challenge the findings. Under the applicable provisions of the Food Safety and Standards Act, 2006, the food business operator can appeal against the food analyst’s report within the prescribed period.
This means the matter remains subject to the regulatory process, including the opportunity available to the food business operator to contest the laboratory findings.
Authorities Order Immediate Stop To Sales

In the meantime, the food safety authorities have instructed the food business operator to immediately stop selling the product identified in the notice.
The direction comes as part of regulatory action concerning packaged food products that are found not to meet established safety and quality requirements during inspections and subsequent laboratory testing.

Nestle India Responds

On the issue, Nestle India spokesperson told Times Now Digital: “Nestlé Low Fat Dairy Whitener is safe to consume and complies with all applicable regulatory requirements. Phosphorus is a nutrient that occurs naturally in milk and is therefore present in all milk-based products.”
The spokesperson said, “FSSAI lab reports reflect total phosphorus against the additive limit, without accounting for the substantial natural phosphorus contribution from milk-based ingredients. Our product is in full compliance for added phosphorus as per prescribed limits under FSSR including for as consumed basis. We have been in continuous engagement with the authorities as per due process established under law and have shared data across other same/similar milk-based products in the category to reflect presence of naturally occurring phosphorous.”
